Mercer conducts surveys for its clients to support pro-competitive benchmarking of employee compensation and benefits. We provide this information to enable clients’ independent decision making in this area. Mercer recognizes that antitrust laws prohibit collusion in the labor market, and Mercer takes a series of steps in collecting, analyzing, and disseminating this data to prevent its misuse. These steps include a requirement of at least five separate data sources, anonymization of those data sources, aggregation of compensation data, and the use of historic, not forward-looking, compensation figures. Mercer further insists that this survey not be used to facilitate improper exchanges or agreements among competitors.
